1. Introduction

1.1 The YooDrive Platform helps Pupils & Parents find Approved Driving Instructors, Approved Driving Instructors to market their services, and for Pupils to book and pay for Lessons. All of these terms and conditions apply to Pupils and Approved Driving Instructors, unless they specifically state otherwise, or are marked with a "ADI", when they only apply to Approved Driving Instructors.  These terms and conditions replace any previous versions.

1.2 The YooDrive Website is owned and operated by Dust cap (UK) LTD, trading as YooDrive. Dust cap (UK) LTD is a limited liability company registered in Scotland under company number SC770680. Dust cap (UK) LTD's registered office is at 2 Lytham Meadows, Bothwell, Glasgow, Scotland G71 8ED. YooDrive's other contact details are set out on the Website, which is at YooDrive.com

1.3 A User may register on the Website as a Pupil or an Approved Driving Instructors. A User may use the Website without registering, but if a User does register, certain information will be stored, making future visits to the Website easier.

1.4 By registering on or using our Website, the User agrees to be bound by these terms and conditions. These terms and conditions are legally binding – every User should read them fully before agreeing to them. (Please print or save these terms for future use as Dust cap (UK) LTD will not keep a file copy specifically for the User and Dust cap (UK) LTD cannot guarantee that they will remain accessible on the Website in future.) If a User does not wish to be bound by these terms, they should not use the Website.

1.5 ("ADI") Where the person who agrees these terms and conditions contracts on behalf of a company/organisation, they hereby confirm that they have authority to act on behalf of that entity.

1.6 Certain words are defined in Definitions section of the terms and conditions and are capitalised throughout.

2.Dust cap (UK) LTD Rights & Responsibilities

This clause sets out what Dust cap (UK) LTD will do. Yoodrive will:

2.1 Help Approved Driving Instructors and Pupils to meet by allowing Approved Driving Instructors to advertise their professional tuition services on the Website, and Pupils to book and pay for Lessons

2.2 Maintain a functioning website, including communication systems, a booking platform and Online Classrooms, wherever possible. Dust cap (UK) LTD cannot guarantee that the Website will always be available, or that it will always work, but it will try to have it up and running properly at all times. The Website may from time to time be taken offline for maintenance purposes.

2.3 Communicate any planned maintenance of the Website or downtime.

2.4 Use reasonable endeavours to keep the Website free from viruses and worms.

2.5 Use reasonable endeavours to check the identity, status and grade of all Approved Driving Instructors.

2.6 Decide when an Approved Driving Instructors profile is sufficiently complete to be set live on the Website and be accessible by other Users.

2.7 Communicate new Bookings, confirmation of Bookings and cancellations, to both Pupils and Approved Driving Instructors via the Website and by email & or SMS Text Messaging (except where a Pupil or Approved Driving Instructor has chosen to alter their notification settings to exclude certain communication).

2.8 Endeavour to ensure that each Pupil's payment of Lesson Fees and the payment of each Approved Driving Instructor. Approved Driving Instructor Fees are processed promptly and usually within 7 days of a Lesson, when there is no Complaint or Failed Payment.

2.9 Endeavour to ensure Complaints are considered promptly and in accordance with these terms and conditions.

2.10 Endeavour to ensure that refunds to Pupils are made promptly in accordance with these terms and conditions.

2.11 Endeavour to ensure that Failed Payments are processed promptly and in accordance with these terms and conditions.

2.12 Take precautions Dust cap (UK) LTD considers appropriate to protect Pupils' and Approved Driving Instructors' information.

2.13 Monitor postings made on the Website and messages sent between Pupils and Approved Driving Instructors. YooDrive does so in the hope of helping Pupils and Approved Driving Instructors meet, but also to stop misuse of the Website, as set out in these terms and conditions.

3. User Responsibilities

– (this applies to both Pupils and Approved Driving Instructors, and anyone else who uses the Website)

3.1 Users are responsible for their own security in conjunction with the services through the Website, both online and offline.

3.2 Users are solely responsible for the material they post on the Website, including messages sent, and they must not post defamatory, offensive or illegal material.

3.3 Users must immediately report to Dust cap (UK) LTD any defamatory, offensive or illegal material they view on the Website.

3.4 Users must exercise their own judgement regarding the accuracy of information provided on the Website. Dust cap (UK) LTD cannot and does not guarantee that all of the content on the Website is complete, accurate or up to date.

3. Users must contact YooDrive immediately if they believe their password has been compromised. Users will be responsible for the actions of any interactions conducted in their name until they have notified YooDrive that they believe their password has been compromised.

3.6 Users must not use the Website with the intention of engaging directly with users outside of the YooDrive environment. Users must not promote opportunities or services of any company other than YooDrive on the Website.

3.7 Users agree to abide by the Privacy Policy provided through the Website.

3.8 Any User who fails, in YooDrive's opinion, to comply with these terms and conditions may be immediately suspended from using the Website and any related services. YooDrive reserves the right to cancel any existing bookings in such circumstances.

Dust cap (UK) LTD ("we", "our" or " YooDrive ") is committed to protecting the privacy of all visitors to our Website YooDrive.co.uk and all visitors who access our Website or services through any mobile application (together, "Website").

Please read the following privacy policy which explains how we use and protect your (“you” or “your” refer to any User, no matter whether you are an Approved Driving Instructor or Pupil) information, as the data controller for the purposes of the GDPR (General Data Protection Regulations EU 2016/679) and related UK legislation.

We reserve the right to modify this notice without notice by posting any changes on our Website.

When you use the YooDrive Platform and the Payment Services, we automatically collect personal information about the services you use and how you use them.

This information is necessary for the adequate performance of the contract between you and us, to enable us to comply with legal obligations and given our legitimate interest in being able to provide and improve the functionalities of the YooDrive Platform and Payment Services.

Information That We Automatically Collect

  • Usage Information. We collect information about your interactions with the YooDrive Platform and App such as the pages or content you view, your searches for Approved Driving Instructors, bookings you have made, messages between parties, jobs created and other actions on the YooDrive Platform.
  • Log Data and Device Information. We automatically collect log data and device information when you access and use the YooDrive Platform and App, even if you have not created a YooDrive Account or logged in. That information includes, among other things: details about how you’ve used the YooDrive Platform (including if you clicked on links to third party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the YooDrive Platform and App.
  • Cookies and Similar Technologies. We use cookies and other similar technologies when you use our platform, use our mobile app, or engage with our online ads or email communications. We may collect certain information by automated means using technologies such as cookies, web beacons, pixels, browser analysis tools, server logs, and mobile identifiers.

In many cases the information we collect using cookies and other tools is only used in a non-identifiable without reference to personal information. For example, we may use the information we collect to better understand Website traffic patterns and to optimize our Website experience. In some cases, we associate the information we collect using cookies and other technology with your personal information. Our business partners may also use these tracking technologies on the YooDrive Platform or engage others to track your behavior on our behalf.

  • Geo-location Information. When you use certain features of the YooDrive Platform and App, we may collect information about your precise or approximate location as determined through data such as your IP address or mobile device’s GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu. YooDrive may also collect this information even when you are not using the app if this connection is enabled through your settings or device permissions.
  • Pixels and SDKs. Third parties, including Facebook, may use cookies, web beacons, and other storage technologies to collect or receive information from our Websites and elsewhere on the internet and use that information to provide measurement services and target ads. For apps, that third parties, including Facebook, may collect or receive information from your app and other apps and use that information to provide measurement services and targeted ads.

Users can opt-out of the collection and use of information for ad targeting by updating their Facebook account ad settings and by contacting support@YooDrive.co.uk with a description of your request and validation information.   • Do Not Track Signals. While you may disable the usage of cookies through your browser settings, the YooDrive Platform currently does not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application due to lack of standardisation regarding how that signal should be interpreted.

Information That We Collect

  • When you visit the Website or purchase a lesson through the Website, you may be asked to provide information about yourself including your name, address, and contact details.
  • When you visit the Website as an Approved Driving Instructor, you may also be asked to upload personal identification documents about yourself, such as a driving license, passport, or Disclosure and Barring check, and may be asked to provide personal banking details.
  • When you register on the Website as an Approved Driving Instructor, we may ask you to provide personal information of individuals who can provide a reference to evidence your suitability to tutor with us.
  • When you register on the Website as an Approved Driving Instructor, we may ask you to provide details of any criminal convictions (including a DBS certificate or update service details).
  • When acting as a referee, you may be asked to provide information about yourself including your name, address, and contact details, and details of the suitability of the Approved Driving Instructor who has provided your details.
  • When you request a lesson from an Approved Driving Instructor, we may collect your payment information, such as credit or debit card information.
  • We may also collect information about your usage of the Website and information about you from the messages you post on the Website, including but not limited to messages you send to an Approved Driving Instructor, files you upload, and your communications with us via email and SMS.
  • We record all online lessons that take place through our platform, store any files you may upload to the online classroom and data on any interactions you may have in the classroom.
  • We collect technical data about your use of the Website, including the device and browser that you are using, your IP address, your time on the Website and the pages that you have visited.
  • We may ask for your payment information, such as debit or credit card details. All payment card information is handled by a third party. We do not handle any payment card information ourselves and are not PCI compliant.

How we use your data

  • Your information will enable us to provide you with access to the relevant parts of the Website and to supply the services you have requested.
  • If you are a Pupil, we will use this data to put you in touch with the Approved Driving Instructor you have contacted, and up to 5 other Approved Driving Instructors that may be able to help with your tuition request. The information will also enable us to bill you for lessons you have completed and contact your where necessary concerning our services.
  • If you are a Approved Driving Instructor, your Identity documents will allow us to comply with Know Your Customer legislation, Recruitment Agency legislation, and your bank details will allow us to pay you for lessons you have completed.
  • If you are an Approved Driving Instructor on our Website, we will screen your application to ensure that your qualifications and experience make you suitable to offer tuition with us, and to ensure that you have the right to work in the UK.
  • If you are an Approved Driving Instructor and have provided details of individuals you wish to provide a reference, we will contact those individuals and request feedback on your suitability to tutor with us.
  • If you are an Approved Driving Instructor who has registered details of any criminal convictions (including a DBS certificate or update service details) we will check these details against the Disclosure and Barring Service database.
  • If you are an Approved Driving Instructor using our Website, in order to make the best matches possible, we may use automated decision making to rank you against other Approved Driving Instructors when displaying search results to Pupils. The main scoring categories used to inform this decision-making process and your current scores are communicated to you through your dashboard on the Website. If your score falls below a certain threshold, your profile may automatically be removed from the results displayed on the Website and you may no longer be given access to jobs. We may remove your profile automatically should we deem you are an inactive Approved Driving Instructor.
  • Your Website use and messaging history will allow us to provide you access to your communications history with Approved Driving Instructors and help us to settle any disputes that may arise.
  • If you are a User of our Website sending messages to other Users, we may screen your messages to ensure that contact details are kept private.
  • If you have completed an online lesson either as a Approved Driving Instructor or a Pupil, we may record the lesson so that you may view it later. In addition, we store lesson recordings to help with safeguarding and ensuring the quality of online lessons.
  • Where you have indicated accordingly, you agree that we may use your information to let you know about our other products and services that may be of interest to you including services that may be the subject of direct marketing and we may contact you to do so by post, telephone, SMS, e-mail, social media or direct mail.
  • We may contact you for internal market research purposes, to find out how we can improve our services to better meet the needs of our users.

Purposes for which we will use your personal data

We have set out below, in a table format, a description of all the ways we plan to use your personal data, and which of the legal bases we rely on to do so. We have also identified what our legitimate interests are where appropriate.

Note that we may process your personal data for more than one lawful ground depending on the specific purpose for which we are using your data. Please contact us if you need details about the specific legal ground we are relying on to process your personal data where more than one ground has been set out in the table below.

Profile details

Profile details provided by Approved Driving Instructors are used to process Approved Driving Instructor applications to join the site. Some data collected by third parties and automatically generated data (Approved Driving Instructor reviews and scores for example) are used to assess Approved Driving Instructors continuing suitability to use YooDrive, as communicated on Instructor dashboards, in our FAQs and in our t&cs.

Credit card information and payment details

To facilitate transactions including billing Pupils for Lessons as agent for the Approved Driving Instructors and passing on payments to Instructors for lessons taught.

Location details

To enable us to fulfil our contract in helping to facilitate matches between Approved Driving Instructors and Pupils through the Website and to allow us to invoice for Lessons. Anonymised location data is also used to aid us in understanding our user base through analytics.

To enable us to display “Background Checked Status” on Approved Driving Instructor profiles, as described in our t&cs.

User preferences are stored to enable us to comply with user preferences. Online lessons are recorded for safeguarding and to ensure quality.

Disclosure of your information

  • For the purposes for which we will use your personal data as described in the previous section, the information you provide to us may be transferred to and stored on our servers, or servers of third-party providers. We have Data Processing Agreements with each of our third-party providers to ensure they comply with their obligations and responsibilities in processing your personal data.
  • Sometimes it may be necessary to transfer data that we collect from you to locations outside of the European Union for processing and storing. In such cases the data transferred is limited to that which is necessary for the processing purpose.
  • Third party data processors that do not transfer your personal data outside of the EEA are Amazon Web Services, ClockworkSMS, Cluvio and Digital Ocean.
  • Third party data processors that may transfer your personal data outside of the EEA are Drip, Google, Sendgrid, Stripe, WizIQ and ActiveCampaign, MessageBird and Hubspot.
  • If you are using the Website, we may disclose your personal information to an Approved Driving Instructor you have contacted, which may include your first name, contact details, and address, for them to provide tuition services to you.
  • If you are using the Website as an Approved Driving Instructor, we may disclose information about you to help match you to new Pupils. This includes your first name, approximate location, any references you have received and any information you have declared on your public profile. If you agree to give lessons to a Pupil, we may also disclose your address and contact details to the Pupil for you to deliver the lesson.
  • If you are using the Website as an Approved Driving Instructor and provide details of criminal convictions (including a DBS certificate or update service details) we will award a DBS-checked status on your profile where your DBS check is found to be clean and within the time restrictions set out within our Terms and Conditions.
  • If you are using the Website as an Approved Driving Instructor and provide details of referees, we will contact those individuals, inform them of your desire to tutor with us and seek feedback on your suitability to do so.
  • If you are using the Website as a referee, we may disclose information about the reference you have provided to the Approved Driving Instructor and other Users visiting our Website. This will be limited to the reference provided, your first name and surname initial.
  • We use third parties to process information such as credit card information and bank account information. By giving us your personal data, you agree to this transfer, storing or processing by these third parties. We never give your details to third parties to use your data to enable them to provide you with information regarding unrelated goods or services.
  • We may use the information that you provide to us if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation; or in order to enforce our Website Terms and any other agreement, or to prevent fraud.
  • In the event that we sell any or all of our business to a buyer or enter into a joint venture with another business entity, your information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.

Security

  • We take protecting your data seriously and take steps to protect your information from unauthorised access, accidental loss, destruction and damage.
  • Unfortunately, the sending of information via the internet is not totally secure and on occasion such information can be intercepted. Although we will take steps to protect your information, we cannot guarantee the security of data that you choose to send us electronically and sending such information is entirely at your own risk.
  • To ensure that all new features and changes to our service adhere to GDPR requirements we follow a design by data protection by design and default approach to all development of our Website and service. This includes using submitting Privacy Impact Assessments to the ICO as needed.

Data Retention

  • We will keep your information for 7 years from the last date on which you have been active on our Website.
  • The exemptions to this period are online lesson recordings which are held for 30 days, and any DBS certificates, which are only held for a 6-month period (details relating to these certificates are kept for the full 7 years to demonstrate our legitimate awarding of the DBS-checked status).
  • Records that you have shared publicly or with another User (e.g., reviews you leave, messages you send and bookings you make) may remain on the Website after your personal information has been deleted, but will no longer have identifying information which links them to you attached.
  • We may retain records where necessary to fulfil our regulatory or statutory duties.

Legal Rights


Under certain circumstances, you have rights under data protection laws in relation to your personal data. These include the below.

To ensure that we can deal with your request as promptly as possible, please ensure you make your request as clearly as possible.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

You have the right to request that we send to you or to another organisation, an electronic copy of the personal data we hold about you in a structured, commonly used and machine-readable format, for example when you are dealing with a different service provider.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests.

Any changes to our Privacy Policy will be posted to the Website and, where appropriate, via e-mail.
